Mark Kelly is suing the War Department.

Last Monday, Pete Hegseth issued a formal Letter of Censure against Kelly, citing his reckless misconduct.

If you'll remember, Kelly and five other representatives urged U.S. military members to refuse illegal orders from President Trump.

This, in the eyes of the War Department, constitutes sedition, although technically members of our military are required to refuse illegal orders.

The idea is that Kelly and his "Seditious Six" knew what they were doing and were only saying "illegal orders" to protect themselves. This, Hegseth says, violates Articles 133 and 134 of the Uniform Code of Military Justice. So Kelly will be demoted and have his retirement pay cut.

And now Kelly is suing the War Department.

Sen. Mark Kelly, D-Ariz., a retired naval officer, is suing the War Department, as well as War Secretary Pete Hegseth, over the agency's actions to demote him and cut his retirement pay for urging military service members to 'refuse illegal orders' in a video message with other leading Democrats.

A federal lawsuit filed in Washington D.C., names Hegseth, the Navy, the Department of Defense - now renamed the War Department - and Navy Secretary John Phelan as defendants.

The lawsuit said the Trump administration's actions 'trample on protections the Constitution singles out as essential to legislative independence.'
